By accessing or using the DJ PlayNow application or related services (collectively, the “Platform”), you agree to be legally bound by these Terms of Service (“Terms”) issued by HQ TEC, Inc.
2. Eligibility
To access or use DJ PlayNow, users must be at least 13 years of age. Users under the age of 18 must obtain parental or legal guardian consent before using the Platform.
3. Account Responsibilities
Users are required to provide accurate and complete information during registration and to maintain the confidentiality of their login credentials. Account holders are fully responsible for all activities that occur under their account. Sharing credentials or impersonating others is strictly prohibited.
4. Platform Usage
a. Partygoers:
• Must purchase tokens, with a minimum purchase of $15, to make song requests.
• Each song request requires tokens equivalent to $3.00.
• Users may upvote other song requests to influence the DJ’s selection.
b. DJs:
• Have discretion to accept or reject song requests.
• Earn a percentage of tokens based on accepted and played requests.
• Must adhere to DJ PlayNow policies and any contractual obligations with venues.
5. Payments and Refunds
All transactions are processed securely through third-party payment providers. Purchases made through the Platform are non-refundable, except where required by law. DJs receive payments according to the terms outlined in the DJ PlayNow agreement.
6. User Conduct
Users agree to behave respectfully and lawfully while using the Platform. Prohibited behavior includes, but is not limited to:
• Harassing DJs or other users.
• Submitting offensive, illegal, or hateful content.
• Using automated tools such as bots or scrapers to interact with the Platform.
• Violating any applicable laws or community standards.
HQ TEC, Inc. reserves the right to suspend or permanently ban any user who violates these Terms, with or without prior notice.
7. Intellectual Property
All intellectual property, including but not limited to trademarks, logos, software code, visual design, and content displayed within the Platform, is the sole property of HQ TEC, Inc. No material from the Platform may be copied, modified, distributed, or used without prior written consent from HQ TEC, Inc.
8. Termination
HQ TEC, Inc. reserves the right to suspend or terminate user accounts at its sole discretion for any violations of these Terms or misuse of the Platform. Upon termination, access to the Platform and associated data may be permanently revoked.
9. Disclaimer
DJ PlayNow is provided on an 'as-is' and 'as-available' basis. HQ TEC, Inc. makes no warranties, express or implied, regarding the reliability, availability, or performance of the Platform, including the fulfillment of song requests or continuous service availability.
10. Limitation of Liability
To the maximum extent permitted by law, HQ TEC, Inc. shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, data, service interruptions, or harm caused by third parties, such as DJs or venue operators.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, USA. All disputes arising out of or in connection with these Terms shall be submitted to binding arbitration located in Indiana.
12. Modifications to Terms
HQ TEC, Inc. reserves the right to amend these Terms at any time. Continued use of DJ PlayNow following any changes constitutes acceptance of the revised Terms.
